OVERVIEW
Welcome to The Hat Dealers. The terms "we", "us", and "our" refer to The Hat Dealers. We operate this store and website — including all related information, features, tools, products, and services — to provide you with a limited, curated shopping experience (the "Services"). Our platform is powered by Shopify, which enables us to provide these Services.
The following Terms of Service ("Terms") together with our Privacy Policy outline your rights and responsibilities when using our Services. Please review carefully. By visiting or purchasing through our site, you agree to these Terms.
In addition, you agree to our Messaging Terms () and Messaging Privacy Policy ().
1. Orders and products
Our products are released as limited drops. Quantities are finite and sold out colourways are generally not restocked. We may limit quantities per customer, per household or per order, and we may refuse or cancel any order — including orders we reasonably believe are placed for resale, placed using automated tools, or placed to circumvent purchase limits.
We make reasonable efforts to display products and pricing accurately, but we do not warrant that product descriptions, images or pricing are error-free. If a product is listed at an incorrect price, we may cancel the order and refund you in full.
All sales of physical products are final. See our Refund Policy and Shipping Policy.
2. Dealer Membership — subscription terms
The Dealer Membership is a paid, recurring access program. Our Cancellation & Subscription Policy sets out the full terms and forms part of these Terms. In summary, and by subscribing you specifically acknowledge and agree:
(a) Recurring charges. The membership costs $10.00 USD per month plus applicable tax. You are charged at signup and then automatically on the same day each month.
(b) Automatic renewal. YOUR MEMBERSHIP RENEWS AUTOMATICALLY AND CONTINUES TO CHARGE YOUR PAYMENT METHOD UNTIL YOU CANCEL. You authorize us and our payment processors to store your payment method and charge it on this recurring basis.
(c) Cancellation. You may cancel at any time with no fee, from your account or by emailing admin@thehatdealers.com. Cancellation takes effect at the end of the period you have already paid for. Cancel at least 24 hours before your renewal date to avoid the next charge.
(d) No refunds on membership fees. Membership fees, including partial months, are non-refundable. Cancelling stops future charges rather than refunding past ones. Duplicate or erroneous charges will be corrected.
(e) Access, not goods. The membership delivers access and benefits. No physical product is shipped as part of the membership itself. Early access does not reserve or guarantee any item.
(f) Changes. We may change the price or the benefits on at least 30 days' email notice, which gives you the opportunity to cancel before the change takes effect.
(g) Non-transferable. Membership is tied to your account. Benefits, early-access links and members-only products may not be resold, shared or transferred. We may cancel a membership without refund for resale or bot activity.
(h) Failed payments. If your payment fails we may retry it, and may suspend or cancel your membership and benefits if it continues to fail.
3. Accounts
Some features, including the Dealer Membership and members-only products, require an account. You are responsible for the accuracy of your account details and for keeping your credentials secure. You are responsible for activity that occurs under your account.
4. Intellectual property
All content on the Services — including designs, artwork, logos, photography, text and layout — is owned by or licensed to The Hat Dealers and is protected by applicable intellectual property law. You may not reproduce, distribute or create derivative works from it without our written permission.
5. Limitation of liability
To the fullest extent permitted by law, The Hat Dealers is not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Services or from any product purchased through them. To the fullest extent permitted by law, our total liability to you for any claim will not exceed the amount you paid us in the twelve months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
6. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute will be brought in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
7. Changes to these Terms
We may update these Terms from time to time. The revised version will be posted here with an updated date. Where a change materially affects your membership, we will give notice as described in section 2(f). Continuing to use the Services after a change takes effect means you accept it.
